ABOUT MEASURES ON ENSURING RATIONAL USE OF LANDS
IN AGRICULTURAL PRODUCTION AND REPRODUCTION OF THEIR FERTILITY

The comparison modern soil-protecƟon legislaƟon with the Soviet period showed that now protecƟon of agricultural lands have been secured is worse. As a way to
correct this, the authors propose a number of measures of organizaƟonal and legislaƟve nature. The process of separaƟon of lands in public ownership, on Federal,
of consƟtuent enƟƟes of the Russian FederaƟon and municipal must to be completed (now 34% of the land Fund of the country has not yet delimited). Over the past
5 years the temps of this process is lower than in previous years (now 47.3 million hectares per year, between 2001 and 2011, there was 70-80 million hectares per
year). A key condiƟon for sustainable use and protecƟon of land in agriculture — a land use planning. Experience of agroholding “Ivanovski” (Belgorod region) shows
that the implementaƟon the project of land use planning leads to sustainable posiƟve humus balance (+2.4 tons per hectare). But now the role and importance of land
use planning is low; and integrated legal regulaƟon for it is missing. The authors propose to adopt a new version of the Federal law “About land use planning” to reflect
the following: the disƟncƟon between public and iniƟaƟve land use planning; funcƟons and powers of federal and regional execuƟve authoriƟes; forms and methods
of parƟcipaƟon self-regulatory organizaƟons and ciƟzens in carrying out land use planning; specifics of land surveying in respect of land under linear producƟon in-
frastructure, the implementaƟon of zoning of agricultural lands and urbanized areas, places of intensive mining and the places of tradiƟonal residence of indigenous
minoriƟes of the North, Siberia and the Far East.
